1. Acceptance of Terms

By accessing or using Nineyarns ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Nineyarns is a platform that enables users to:

Create personalized question lists for capturing life stories
Send questions to designated authors via email on a scheduled basis (daily or weekly)
Collect and store responses to questions
Download completed stories as PDF documents
Order professionally printed hardcover books through our printing partner
Share access to question lists with family members

3. Account Registration

To use certain features of the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update this information as necessary. We use passwordless authentication via magic links sent to your email address.

4. User Roles and Responsibilities

Requestors

As a requestor, you create question lists and invite authors to respond. You are responsible for ensuring you have appropriate permission to contact the author via email and that the questions you create are appropriate and lawful.

Authors

As an author, you receive questions via email and provide responses. By accepting an invitation, you consent to receiving scheduled emails containing questions. You retain ownership of your responses and grant Nineyarns a license to store, display, and include your content in printed materials ordered through the Service.

Shared Access

Requestors may grant read or write access to other users. Users with shared access must respect the privacy and wishes of both the requestor and author.

5. Payments and Pricing

The Service offers the following paid features:

Question Lists: A one-time fee of $5 per question list, which includes unlimited questions, scheduled email delivery, and free PDF download
Printed Books: Variable pricing starting at approximately $30, depending on book size, binding options, and shipping destination

All payments are processed securely through Stripe. Prices are displayed in USD and may vary based on your location for printed books. PDF downloads are included free with each question list purchase.

6. Refund Policy

Question list purchases are non-refundable once questions have been sent to the author. For printed books, refunds or reprints may be available if the book arrives damaged or with printing defects. Please contact us within 14 days of receiving your order to report any issues. Refund requests for printed books are handled on a case-by-case basis in coordination with our printing partner.

7. User Content

You retain ownership of all content you create or submit through the Service, including questions and responses. By using the Service, you grant Nineyarns a non-exclusive, worldwide, royalty-free license to:

Store and display your content within the Service
Generate PDFs containing your content
Transmit your content to our printing partner for book production
Send your content via email as part of the question delivery feature

You are solely responsible for the content you submit and must ensure it does not violate any laws or infringe on the rights of others.

8. Prohibited Uses

You agree not to use the Service to:

Send unsolicited or harassing communications
Invite authors without their prior consent
Submit content that is illegal, defamatory, obscene, or infringes on intellectual property rights
Attempt to gain unauthorized access to other users' accounts or data
Interfere with or disrupt the Service or its servers
Use the Service for any commercial purpose other than personal family storytelling

9. Printed Books and Fulfillment

Printed books are produced and shipped by our third-party printing partner, Lulu. Shipping times and costs vary by destination. Once an order is submitted for printing, it cannot be canceled or modified. We are not responsible for delays caused by the printing partner, shipping carriers, or customs processing. Book orders include tracking information when available.

10. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your data as described in our Privacy Policy.

11. Email Communications

By using the Service, you consent to receiving transactional emails including magic link authentication, question deliveries, and order confirmations. Authors who accept an invitation consent to receiving scheduled question emails. You may stop receiving question emails by contacting support, though this will pause the question list.

12. Intellectual Property

The Service, including its design, features, and built-in question templates, is owned by Nineyarns and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent. The built-in questions provided are licensed for your personal use within the Service only.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE QUALITY OF PRINTED BOOKS BEYOND COORDINATING WITH OUR PRINTING PARTNER ON DEFECT CLAIMS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NINEYARNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

15. Account Termination

You may delete your account at any time by contacting support. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data may be retained for a reasonable period for legal compliance purposes, after which it will be deleted in accordance with our data retention policies.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law
